OVERVIEW
Welcome to SpaCoverLabs.
These Terms of Service ("Terms") govern your access to and use of the SpaCoverLabs website, online store, product configurator, products and related services (collectively, the "Services").
SpaCoverLabs is a trading brand operated by Baltz & Partners Kft. Throughout these Terms, "SpaCoverLabs", "we", "us" and "our" refer to Baltz & Partners Kft.
Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
By accessing, browsing or using our Services, or by placing an order with us, you agree to be bound by these Terms together with our Privacy Policy, Returns & Refund Policy, Shipping Policy, Warranty Policy and any other policies or information referenced on our website.
If you do not agree with these Terms, you should not use the Services or place an order with us.
SECTION 1 — ELIGIBILITY AND CUSTOMER INFORMATION
By using the Services or placing an order, you confirm that you are at least 18 years old or otherwise legally capable of entering into a binding agreement under the laws applicable to you.
You agree to provide accurate, complete and up-to-date information when placing an order, using our configurator, contacting us or creating an account.
You are responsible for ensuring that information supplied to us, including your name, billing and delivery details, spa brand, spa model, measurements, configuration selections and other order information, is accurate before submitting your order.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.
We may suspend or restrict access to an account where we reasonably believe that information provided is false, misleading, fraudulent or being used unlawfully.
SECTION 2 — PRODUCTS AND PRODUCT INFORMATION
SpaCoverLabs specialises in replacement covers for hot tubs, spas, swim spas and related products. Many of our covers are custom-made or manufactured to order according to spa model specifications, customer-supplied measurements or individual configuration selections.
We make every reasonable effort to ensure that product descriptions, specifications, measurements, materials, colours, photographs, illustrations and other information displayed through the Services are accurate.
However, colours and appearance may vary slightly depending on screen settings, lighting conditions, photography, manufacturing processes and material characteristics.
Product images, diagrams and technical illustrations may be provided for explanatory or illustrative purposes and may not represent every individual product configuration exactly.
Product specifications, materials, construction methods, available options, colours, insulation levels and other product characteristics may be updated from time to time where this does not materially reduce the agreed functionality or quality of an order already accepted by us.
We reserve the right to modify or discontinue products, options or Services, subject to any contractual obligations relating to orders that we have already accepted.
SECTION 3 — SPA MODEL DATABASE AND VERIFIED SPECIFICATIONS
Our Services may allow you to search for your spa by brand and model and, for supported models, automatically load dimensions, shape, corner radius or other specifications from our spa model database.
We take reasonable steps to maintain and verify the information contained in our database. However, spa manufacturers may change specifications between production years, product revisions, markets or manufacturing locations without changing the model name.
For this reason, you are responsible for reviewing the specifications displayed during the ordering process and notifying us before ordering if they appear inconsistent with your spa.
If you are uncertain about your spa model or specifications, you should contact us before placing your order. We may request photographs, serial number information or measurements to assist with identification.
Where we expressly confirm specifications with you before production, the confirmed specifications will form part of the agreed product specification for your order.
SECTION 4 — CUSTOMER-SUPPLIED MEASUREMENTS
If your replacement spa cover is manufactured using measurements supplied by you, you are responsible for ensuring that those measurements are complete and accurate.
This may include, where applicable, the overall width, length, corner radius, skirt length, hinge position, shape and any other measurements requested during the configuration process.
We provide measuring guides and support to help customers obtain accurate measurements. If you are uncertain about any measurement, we strongly recommend contacting us before placing your order.
Where you submit photographs, measurements or other information for review, we will make reasonable efforts to identify obvious inconsistencies. However, unless we expressly confirm otherwise in writing, such review does not transfer responsibility for the accuracy of customer-supplied measurements to SpaCoverLabs.
If a product is manufactured correctly according to measurements or specifications supplied and approved by you, but does not fit because those measurements or specifications were incorrect, this will not normally constitute a manufacturing defect or product non-conformity.
This section does not affect your statutory rights where a product is defective, incorrectly manufactured or does not conform to the specifications agreed with us.
SECTION 5 — PRODUCT CONFIGURATION
Our configurator allows you to select characteristics such as product dimensions, shape, corner radius, insulation, colour, skirt length and other available options.
You are responsible for reviewing your selected configuration before submitting your order.
The order summary presented before checkout forms an important part of your order information. Please check all specifications carefully before completing your purchase.
If you notice an error after placing your order, contact us as soon as possible. We will make reasonable efforts to assist, but changes cannot be guaranteed once an order has entered preparation or production.
SECTION 6 — ORDERS AND ORDER ACCEPTANCE
Placing an order through the Services constitutes an offer to purchase the selected products from Baltz & Partners Kft. trading as SpaCoverLabs.
After placing an order, you will normally receive an electronic confirmation acknowledging that we have received it.
We reserve the right to review an order before accepting it, including where clarification of measurements, product specifications, payment information, delivery details or other order information is required.
We may refuse or cancel an order where reasonably necessary, including in cases of pricing or technical errors, suspected fraud, unavailable products or materials, payment failure, invalid delivery information, inability to manufacture the requested configuration or other legitimate reasons.
If we cancel an order after payment has been received and no alternative arrangement has been agreed with you, amounts paid for the cancelled order will be refunded using the applicable payment method.
You are responsible for reviewing all order information before completing your purchase.
SECTION 7 — CUSTOM-MADE AND MADE-TO-ORDER PRODUCTS
Replacement spa covers supplied by SpaCoverLabs are generally custom-made or made to order according to individual specifications. These specifications may include a selected spa model, dimensions, shape, corner radius, colour, insulation, skirt length or other configuration choices.
Under applicable EU consumer law, the standard right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised.
Accordingly, a custom-made replacement spa cover cannot normally be returned or cancelled simply because you change your mind.
If you contact us shortly after placing an order and production preparations have not progressed, we may, at our discretion, agree to a modification or cancellation. Any such accommodation is voluntary and does not create an ongoing right to cancel custom-made orders.
The exclusion from the right of withdrawal does not affect your statutory rights if a custom-made product is defective, damaged, incorrectly manufactured or otherwise fails to conform to the agreed specifications.

SECTION 8 — MANUFACTURING AND TOLERANCES
Spa covers are manufactured using flexible materials, insulation cores and other components that may naturally involve minor manufacturing tolerances.
Small variations in dimensions, seams, stitching, material appearance, positioning or finished shape may occur as part of the manufacturing process.
Such minor variations do not necessarily constitute a defect where they do not materially affect the cover's fit, intended use, functionality or conformity with the agreed product specification.
Nothing in this section excludes or limits your statutory rights relating to defective or non-conforming goods.
SECTION 9 — PRICES AND PAYMENT
Prices displayed through the Services are shown in the selected currency and include VAT where required, unless expressly stated otherwise.
Applicable shipping charges and any other charges payable through our checkout will be displayed before you complete your order.
For deliveries arranged outside the European Union, additional customs duties, import VAT, brokerage charges or similar costs may apply. Unless otherwise agreed, such charges are the responsibility of the recipient.
We may change prices, promotions or discounts at any time. Changes will not affect orders already accepted by us except where required to correct an obvious error and permitted by applicable law.
Payments are processed through payment providers available through Shopify or other authorised payment services.
You agree to provide valid payment information and confirm that you are authorised to use the selected payment method.
SECTION 10 — SHIPPING AND DELIVERY
Our standard delivery service is available within the European Union to destinations supported by our checkout and shipping providers.
If you require delivery outside the European Union, please contact us before ordering. Delivery outside the EU may be possible by prior arrangement and may be subject to additional shipping costs, customs procedures, duties or taxes.
Production and delivery estimates displayed on our website or communicated to you are estimates unless we expressly agree to a guaranteed delivery date.
Custom-made products require manufacturing time before dispatch.
We will make reasonable efforts to meet estimated production and delivery times but delays may occur due to carrier disruptions, material availability, production circumstances, severe weather, public authority actions or other events beyond our reasonable control.
You are responsible for providing a complete and accurate shipping address and for informing us of any relevant delivery restrictions.
For consumer orders where we arrange delivery, risk of loss or damage generally passes to you when you or a person designated by you takes physical possession of the goods, subject to applicable law.
If you independently appoint a carrier that was not offered by us, different rules regarding transfer of risk may apply under applicable law.
Please inspect the packaging and product after delivery and notify us as soon as reasonably possible if you discover visible transport damage, missing items or other delivery issues.
SECTION 11 — RETURNS AND RIGHT OF WITHDRAWAL
Consumers purchasing eligible standard, non-custom products at a distance generally have a statutory right to withdraw from the purchase within 14 days of delivery, subject to applicable law and statutory exceptions.
Spa covers and other products manufactured according to your individual specifications may fall within the statutory exception for goods made to the consumer's specifications or clearly personalised and therefore do not generally carry the standard 14-day change-of-mind withdrawal right.
Where SpaCoverLabs voluntarily provides a longer return period for eligible standard products, the conditions of that additional return policy are described in our Returns & Refund Policy.
Nothing in our Returns & Refund Policy or these Terms limits your mandatory statutory rights regarding defective or non-conforming goods.
SECTION 12 — STATUTORY CONSUMER RIGHTS
Nothing in these Terms excludes, restricts or replaces rights that consumers are entitled to under mandatory consumer protection law.
Consumers in the European Union are entitled to statutory remedies where goods are defective, do not conform to the contract, do not correspond with their description or fail to provide characteristics that were agreed or reasonably expected under applicable law.
Where applicable, statutory remedies may include repair, replacement, a proportionate price reduction or termination of the sales contract, subject to the conditions and order of remedies established by applicable law.
EU consumers generally benefit from a minimum two-year legal guarantee of conformity from delivery, although national laws may provide additional protection.
SECTION 13 — COMMERCIAL WARRANTY
Certain SpaCoverLabs products may be supplied with a commercial warranty in addition to your statutory consumer rights.
Where a product is advertised with a 2-Year Warranty, the scope, conditions, exclusions and claim procedure applicable to that commercial warranty are set out in our Warranty Policy or warranty documentation supplied with the product.
Any commercial warranty provided by SpaCoverLabs is additional to, and does not limit, replace or reduce, statutory rights available to consumers under applicable law.
Normal wear and tear, damage caused by misuse, incorrect handling, improper storage, unauthorised modification, failure to follow care instructions or external causes may be excluded from a commercial warranty where permitted by law.
SECTION 14 — PRODUCT CARE AND SAFE USE
You are responsible for using and maintaining products in accordance with their intended purpose and any instructions or recommendations supplied by SpaCoverLabs.
Spa covers should be handled, installed, cleaned and stored appropriately to avoid unnecessary damage and premature wear.
Unless a product is expressly described and certified for such use, a spa cover is not intended to be walked on, stood on, sat on or used as a platform or load-bearing surface.
Children and pets should not be permitted to climb or play on spa covers.
You should not place heavy or sharp objects on the cover or expose it to conditions inconsistent with its intended use.
We are not responsible for damage caused by misuse, neglect, improper installation or handling, unauthorised modifications, unsuitable storage or failure to follow care and safety instructions, except where liability cannot lawfully be excluded.
SECTION 15 — INTELLECTUAL PROPERTY
Unless otherwise stated, content available through the Services, including text, graphics, photographs, illustrations, icons, logos, branding, databases, website design, product information, configuration interfaces and other materials, is owned by or licensed to SpaCoverLabs, Baltz & Partners Kft. or their respective licensors and is protected by applicable intellectual property laws.
You may use the Services and their content for your personal, non-commercial shopping and informational purposes.
You may not copy, reproduce, republish, distribute, modify, scrape, systematically extract, sell, license or commercially exploit our content or databases without prior written permission, except where expressly permitted by applicable law.
Third-party names, spa brands, model names and trademarks displayed on the Services remain the property of their respective owners. Their use is for identification and compatibility purposes and does not imply affiliation, sponsorship or endorsement unless expressly stated.
SECTION 16 — THIRD-PARTY SERVICES AND LINKS
The Services may contain links to websites, applications, payment providers, delivery services, tools or other services operated by third parties.
Third-party services are subject to their own terms, conditions and privacy practices.
We are not responsible for third-party content, availability or practices except to the extent that responsibility cannot be excluded under applicable law.
The inclusion of a third-party link does not necessarily constitute endorsement of that third party.
SECTION 17 — SHOPIFY PLATFORM
Our online store is hosted by Shopify, which provides the e-commerce infrastructure used to operate the Services.
Certain aspects of hosting, checkout, payment processing, security, analytics and other functionality may be provided by Shopify or Shopify-integrated services.
Your use of these features may involve processing of information by Shopify in accordance with Shopify's applicable terms and privacy policies.

SECTION 18 — PHOTOGRAPHS, REVIEWS AND OTHER USER CONTENT
You may provide us with photographs, measurements, serial plate images, product reviews, feedback, comments, suggestions or other information in connection with orders, product identification, customer support or use of the Services.
Photographs and information provided privately for spa identification, measurement verification, order processing, support or warranty purposes will be handled in accordance with our Privacy Policy and will not automatically be treated as marketing content.
If you voluntarily submit a public review, testimonial or other content specifically for publication, you grant us a non-exclusive, worldwide, royalty-free licence to reproduce, display and publish that content in connection with our business and Services, subject to applicable law.
You confirm that any content you provide is either owned by you or that you have the necessary permission to provide it, and that it does not unlawfully infringe the rights of another person.
We may remove public user content that is unlawful, abusive, misleading, infringing or otherwise inappropriate.
SECTION 19 — PROHIBITED USES
You may not use the Services:
- for unlawful, fraudulent or abusive purposes;
- to violate applicable laws or regulations;
- to infringe intellectual property, privacy or other rights;
- to transmit malware, malicious code or harmful technologies;
- to interfere with the operation, availability or security of the Services;
- to attempt unauthorised access to systems, accounts or data;
- to collect or process personal information of others unlawfully;
- to use automated systems to scrape or systematically extract our proprietary database or website content without permission; or
- to engage in fraudulent, misleading or malicious activity.
We may restrict or terminate access to the Services where reasonably necessary to prevent or respond to prohibited activity.
SECTION 20 — SERVICE AVAILABILITY AND WEBSITE INFORMATION
We aim to keep our website and Services available and accurate, but we cannot guarantee that they will always operate without interruption, delay or technical error.
We may temporarily suspend or modify parts of the Services for maintenance, security, upgrades or other operational reasons.
If we discover a material error affecting an order you have placed, we will contact you and seek to resolve the matter in accordance with applicable law.
SECTION 21 — LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights.
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was entered into.
We are not responsible for losses resulting solely from incorrect information, specifications or measurements supplied by the customer where the product has been correctly manufactured according to those agreed specifications.
We are also not responsible for damage resulting from misuse, improper handling, incorrect installation, unauthorised modification or failure to follow product instructions, except where such exclusion would be unlawful.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that applicable law does not permit us to exclude or limit.
SECTION 22 — BUSINESS CUSTOMERS
If you purchase products wholly or mainly for purposes relating to your trade, business, craft or profession, you may be treated as a business customer rather than a consumer.
Certain statutory consumer rights described in these Terms, including consumer withdrawal rights, may not apply to business purchases.
Unless otherwise agreed in writing, these Terms apply to both consumer and business customers to the extent appropriate, subject to mandatory applicable law.
SECTION 23 — FORCE MAJEURE
We will not be liable for delay or failure to perform an obligation where performance is prevented or materially affected by circumstances beyond our reasonable control.
Such circumstances may include severe weather, natural disasters, fires, floods, transportation or logistics disruptions, strikes, labour shortages, epidemics or pandemics, war, civil disturbance, government action, utility or telecommunications failures, material shortages or significant supplier disruption.
If such an event materially affects an accepted order, we will make reasonable efforts to inform you and minimise the effect of the delay.
This section does not remove any rights you may have under mandatory consumer law where performance becomes impossible or is excessively delayed.
SECTION 24 — ELECTRONIC COMMUNICATIONS
By using the Services and providing us with your contact information, you agree that transactional communications may be provided electronically where permitted by law.
These communications may include order confirmations, invoices, payment information, requests for clarification, production updates, delivery notifications, warranty correspondence and customer support communications.
Marketing communications are governed separately by applicable marketing and privacy laws and by the preferences or consent you provide.
SECTION 25 — PRIVACY
Our collection and processing of personal information is governed by our Privacy Policy.
This includes personal information submitted through our website, checkout, configurator, contact forms and customer support channels, as well as photographs, spa information and measurements that may be linked to an individual customer or order.
SECTION 26 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
SECTION 27 — NO WAIVER
If we do not immediately exercise or enforce a right available to us under these Terms, this does not mean that we waive that right.
Any waiver must be expressly agreed and will apply only to the specific circumstances for which it is given.
SECTION 28 — GOVERNING LAW AND CONSUMER JURISDICTION
These Terms and contracts entered into through the Services are governed by the laws of Hungary and applicable European Union law.
If you are a consumer residing in another European Union Member State, this choice of law does not deprive you of mandatory consumer protections available to you under the laws that would otherwise apply in your country of residence.
Any dispute will be subject to the jurisdiction determined by applicable law. Nothing in these Terms requires a consumer to bring proceedings exclusively before the Hungarian courts where mandatory consumer jurisdiction rules give the consumer the right to bring proceedings elsewhere.
SECTION 29 — COMPLAINTS
If you have a complaint regarding an order, product or our Services, please contact us first so that we can attempt to resolve the matter directly.

Consumers may also have access to consumer protection bodies or alternative dispute resolution procedures in their country of residence where provided by applicable law.
SECTION 30 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices, technologies or applicable legal requirements.
The current version will be published on this page together with the updated revision date.
Changes to these Terms will not retrospectively alter the contractual terms applicable to an order already concluded unless required by law or expressly agreed with you.
Your continued use of the website after updated Terms are published means that the updated Terms apply to your subsequent use of the Services and future orders, subject to applicable law.
